TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

INFORMATION ON HOW TO ENTER AND THE PRIZE FORM PART OF THESE OFFICIAL RULES. BY ENTERING (OR OTHERWISE PARTICIPATING IN) THE PROMOTION, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A BINDING CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS CONTRACT INCLUDES INDEMNITIES TO THE PROMOTION PARTIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

1. ELIGIBILITY: The Tradesman Nutrition November Giveaway (“Promotion”, “Sweepstakes”, or “Prize Draw”) is open only to legal residents of the 48 contiguous United States (excluding Alaska and Hawaii), the District of Columbia, Canada (excluding residents of the Province of Quebec), the United Kingdom and Australia (excluding residents of Australian Capital Territory and Southern Australia) (collectively, the “Territory”), who are at least eighteen (18) years of age and the legal age of majority in their jurisdiction of residence as of date of entry. You must have a valid driver’s license issued in your jurisdiction of residence at the time of prize award to claim the vehicle prize. Employees, officers and directors of B Bros LLC (“Sponsor”), Marden-Kane, Inc. (“Administrator”) and their respective parent companies, affiliates, subsidiaries, advertising, contest, fulfillment and marketing agencies (collectively, the “Promotion Parties”), their immediate family members and those living in the same household as such individuals (whether legally related or not) are not eligible to participate in the Promotions or win a prize. For purposes of this Promotion, immediate family members are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren and their respective spouses, and those living in the same household shall mean people who share the same residence (based on both the billing and shipping addresses provided) at least three (3) months out of a year, whether legally related or not. By participating in the Promotion, and to the extent permitted by applicable law and except for any liability that cannot by law be excluded, you release, discharge and hold harmless the Promotion Parties from any and all damages whether direct or indirect, which may be due to or arise out of participation in the Promotion or any portion thereof, or the acceptance, use/misuse or possession of any prize, including related travel or other activities (except any loss, damage, personal injury or death occurring as a result of taking up the prize where it is caused by the gross negligence or breach of the Sponsor). Void outside of the Territory and void where prohibited by law. All applicable federal, state, provincial, territorial, municipal, and local laws and regulations apply.

By participating in the Promotion, you agree to these “Official Rules” and the decisions of Sponsor, including the interpretation of these Official Rules, administration of the Promotion, selection of the winner, and Sponsor’s exercise of discretion, acting reasonably and in accordance with these Official Rules, which will be final, non-appealable, and binding in all respects, to the extent permitted by applicable law.

For residents of Australia: Nothing in these Official Rules limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia.

2. TIMING: The Promotion begins at 12:00 a.m. United States Pacific Time (“USPT”) on November 5, 2026 (Australian residents: 7pm AEDT on November 5, 2026) and ends at 11:59:59p.m. USPT on December 6, 2026 (Australian residents: 6:59:59pm AEDT on December 7, 2026) (the “Promotion Period”). The designated computer clock of the Sponsor is the official time-keeping device in the Promotion. Entrants to the Promotion outside of USPT must check their country’s corresponding local time.

3. HOW TO ENTER: During the Promotion Period, there are multiple ways to earn entries, as set forth below. All methods require you to have an active internet connection and a compatible device that allows you access to the internet.

A. Make a Purchase: You may earn entries for purchasing products from www.Tradesmannutrition.com (the “Website”). During the Promotion Period you will receive one (1) entry for every $1 USD equivalent spent on any product available at the Website. For example, if a product is purchased (current MSRP: $80 USD, $115 AUD, £60 GBP, $112 CAD), you will receive 80 entries. The number of entries you receive will be based on the USD list price of your eligible purchase (excluding any sales tax, and shipping charges), less any credits or discounts, and rounded up to the nearest whole entry. Purchases made using a gift card are not eligible to receive entries; however, a purchase that exceeds the gift card value will be eligible to receive entries based on the balance due after the gift card is applied to the item purchased. If a purchase is returned prior to the end of the Promotion Period, entries associated with that purchase will be voided. All purchases are subject to Sponsor’s return policy at: https://tradesmannutrition.com/policies/refund-policy. There is no limit to receiving entries via this Purchase Method; however, total entries are subject to the limit set forth below.

Multiplier Periods: In addition to the initial entry calculation as set forth above, surprise “Multiplier Periods” as announced at the Website during the Promotion Period will result in an additional bonus entry multiplier on all products. Multiplier Periods will have a range of 2X multiplier to 10X multiplier, as noted at the Website during the announcement. For example, during a 2x Multiplier Period, a purchase of a $50 USD product will result in receiving 100 entries.

B. Free Alternate Method of Entry: To receive forty (40) entries without purchasing a product on the Website, send an email containing your complete name, mailing address, age, email address and phone number to: Giveaway@tradesmannutrition.com with the subject line “Tradesman Nutrition November Giveaway Entry”. Proof of submission does not constitute proof of receipt.

Email Entries must be sent and received by 11:59:59 p.m. USPT on December 6, 2026 (Australian residents: 6:59:59 pm AEDT on December 7, 2026) to be eligible for the Promotion.

The Promotion Parties are not responsible for technical difficulties of any kind, or for false, incorrect, changed, incomplete or illegible contact information.

Entries generated by artificial intelligence, script, computer programs, macro, programmed, robotic or other automated means are void, and the individual generating such entries may be disqualified. Entries that are in excess of the stated limits, incomplete, incomprehensible, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Promotion at Sponsor’s sole and absolute discretion. Those who do not follow all instructions, provide the required information in their entry, or abide by these Official Rules or other instructions of Sponsor may be disqualified. Entries submitted by those who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Entrants are not permitted to share an email address or a telephone number. In the event of a dispute over the identity of an entrant, the entry will be deemed submitted by the registered account holder of the email address and/or telephone number associated with such entry, provided that person is eligible; the decision as to which method to use to determine the identity of the entrant is to be made in Sponsor’s discretion. Potential winner may be required to show proof of being the registered account holder. Registered account holder is defined as the person assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses, or the person assigned to a telephone number by the wireless carrier responsible for assigning such telephone number. In the event that a dispute regarding the identity of the individual who submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry(ies) will be deemed ineligible, and any individual(s) may be disqualified.

4. PROMOTION DRAWING: On December 14, 2026 at 6:00 p.m. USET (Australian residents: 10am AEDT on December 15, 2026) a representative of the independent third-party Administrator (human) located at L3/162 Collins Street, Melbourne VIC 3000 will, in the presence of an independent scrutineer, conduct a random, computerized drawing processed by an algorithm that simulates a random draw to select one (1) potential winner from among all eligible entries received in accordance with these Official Rules. The Sponsor may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

A draw for any unclaimed prize may take place on January 14, 2027 at 6:00 p.m. USET (Australian residents: 10am AEDT on January 15, 2027) at the same place as the original draw, subject to any directions from a regulatory authority.

If the potential winner is a resident of Australia, the prize must be claimed by January 11, 2027 (for the original winner) and February 9, 2027 (for the winner of the unclaimed prize draw, if any).

5. ODDS: Odds of winning the prize depend on the total number of eligible entries received for the Promotion.

6. WINNER NOTIFICATION/PRIZE CLAIMING: The potential winner will be notified via email (or other contact information) using the information provided upon entry within seven (7) days after the drawing (including seven (7) days of the unclaimed prize drawing, if required). The Promotion Parties are not responsible for and shall not be liable for incorrect, changed, or illegible contact information or for electronic communications that are undeliverable as a result of any form of active or passive filtering, or insufficient space in entrant’s email or other account to receive messages. Promotion Parties are not responsible for late, lost, intercepted, misdirected, or unsuccessful efforts to notify the potential winner, or prize claims. Notification is deemed to have occurred immediately upon the sending of an email. Subject to the unclaimed prize draw date, if the potential winner cannot be contacted before the unclaimed prize draw date, if the potential winner is ineligible, if any notification is returned undeliverable, or if the potential winner otherwise fails to fully comply with these Official Rules, potential winner will forfeit that prize and an alternate winner may be selected from among all remaining eligible entries. As part of the winner notification process, potential winner will be required to complete and submit a declaration of eligibility/release of liability/prize acceptance agreement (“Declaration”), within the time stipulated by the Sponsor, as a condition of receiving the prize. Additionally, if a Canadian resident is selected as the potential winner, he/she must correctly answer unaided a time-limited four-part mathematical skill-testing question as a condition of receiving the prize. “Unaided” includes no use of a calculator, artificial intelligence, or assistance from a third-party. If the potential winner fails or refuses to sign and return the Declaration, or fails to correctly answer the skill-testing question (if a Canadian resident), within the required time period or if the Declaration is returned as rejected, faulty, unclaimed or returned as undeliverable to potential winner, and/or the potential winner is otherwise noncompliant, the potential winner will be disqualified and an alternate will be selected for up to ten (10) alternates (where permitted by applicable law), in accordance with these Official Rules and applicable law after which the applicable prize will remain un-awarded. Potential winner becomes a “winner” only after verification of eligibility by Sponsor.

No more than the one (1) prize will be awarded. If, for any reason, more bona fide winners come forward seeking to claim the one (1) available prize, the winner of the one (1) advertised prize available may be selected in a random drawing from among all persons making purportedly valid claims for such prize, in accordance with these Official Rules and applicable law, without prejudice to participant’s rights under applicable law. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.

The surname and country of residence of the winner will be made available on request, as required by applicable law. If the winner is from Australia, their information will be published (initial, surname and postcode) on https://tradesmannutrition.com by December 15, 2026. If the winner is an unclaimed prize winner from Australia, their information will be published (initial, surname and postcode) on https://tradesmannutrition.com by January 20, 2027.

7. PRIZE/PRIZE RESTRICTIONS: The first valid entry drawn is a potential winner, subject to verification, will win a prize only after they are confirmed. One (1) prize package is available to be awarded in the Promotion. Winner will receive a 2025 Ford Raptor R vehicle with automatic transmission, and $30,000 USD (43,179.00 AUD / £22,437.00 GBP / $41,940 CAD) in cash which may be used by winner to defray to tax liability on the prize. The approximate retail value (“ARV”) of the vehicle based on local MSRP is $156,898 USD (Up to $223,218.78 AUD for Australian residents*, £117,344.01 for residents of the United Kingdom, and $219,343.40 CAD for residents of Canada). The total ARV of the one (1) prize package available to be awarded is $186,898.00 USD ($266,397.78 AUD/£139,781.01 GBP/$261,283.40 CAD). All values are based on the exchange rate from US Dollars as calculated on October 20, 2026.

The cash portion of the prize may be awarded as an ACH Transfer to the winner’s designated bank account in the winner’s nominated bank account in the currency of their country of residence, in the winner’s name, initiated by the Sponsor. The cash portion of the prize is drawn on US funds, and the local ARV will depend on applicable currency exchange rates at the time of the ACH Transfer. For purposes of these Official Rules, currency exchange rate is based on published rates as of October 20, 2026.

*For Australian residents, total vehicle prize value includes registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. If the winner is, through any legal incapacity or otherwise, unable to register the vehicle in their own name, then the winner may assign the vehicle to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Sponsor takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Sponsor with certified copies of all required documentation as required by the Sponsor before the vehicle is awarded.

Any difference between the actual value of a prize and the stated ARV (if less than the actual value) due to currency exchange rates and/or differences in local MSRP will not be awarded, to the extent permitted by applicable law. If winner is from Australia, such winner will bear the valuation exposure due to changes in foreign exchange values, and any difference will not be awarded.

Conditions for the vehicle prize: Color, package, factory options, and other specifics of a vehicle prize are determined by Sponsor, and no further options are available. Winner must be a licensed driver and must present a current valid driver's license issued in the winner’s jurisdiction of residence, and legally-required proof of insurance (as applicable in winner’s jurisdiction of residence) prior to taking possession of such vehicle prize, failure to show same may result in vehicle prize forfeiture. Winner is responsible for all associated vehicle fees as required by such winner’s jurisdiction of residence, including all title, license, insurance (excluding compulsory third party insurance for Australian residents), registration (excluding Australian residents), applicable taxes or fees, destination and handling charges, and other fees associated with a vehicle, including any travel and transportation costs associated with collecting the vehicle prize (excluding Australian residents), as well as any fuel required to operate the vehicle. If the winner resides outside of the United States, they will be solely responsible for all international tax remittance fees. Winner is solely responsible for any required maintenance or repairs of the vehicle subsequent to claiming the vehicle prize, and Sponsor has absolutely no duties or obligations with respect to the same. All other costs not specifically stated herein as being awarded are the responsibility of the winner. The Sponsor or its designee will arrange for the title transfer of the vehicle to the winner prior to delivery. Vehicle portion of prize will be delivered to the winner from Sponsor at a mutually-agreed upon location and on a date selected by Sponsor in its sole and absolute discretion. To the extent permitted by applicable law (taking into account any statutory guarantees applicable to consumers under local laws), except as stated in the manufacturer’s limited warranty for the vehicle, none of Sponsor or any other person associated with the manufacture, distribution, development and execution of this Promotion and its Prize, or any of their respective affiliates, parent companies, subsidiaries, directors, officers, employees, and agents makes any warranties, representations or guarantees, express or implied, in fact or in law, relative to the use or enjoyment of the vehicle, including, without limitation, its quality, mechanical condition, merchantability or fitness for a particular purpose. The winner will be responsible for proper licensing and registration (excluding Australian residents) within their jurisdiction of residence. The winner is recommended to confirm with a local dealership the applicable warranties, and Sponsor is not responsible for any warranties that are not transferable upon title transfer. Vehicle portion of prize will be awarded “AS IS.” Vehicle prize is not redeemable for cash, except in Sponsor's sole discretion, and as further described below. Any and all guarantees and warranties for a vehicle prize are subject to the manufacturer’s terms and conditions, and the vehicle prize winner agrees to look solely to such manufacturers for any such warranty or guarantee claim.

Prizes are non-transferable, with no cash redemptions, equivalents, or substitutions except at Sponsor’s sole and absolute discretion. All prize details not specified in these Official Rules are subject to reasonable determination by Sponsor, provided that such determination does not alter the nature, value, or essential prize characteristics of the prize as disclosed to consumers. Prize details and availability are subject to change due to circumstances not attributable to Sponsor and subject to applicable rules and restrictions. In the event that the vehicle prize becomes unavailable as determined in Sponsor’s sole discretion, except in cases where such unavailability is attributable to the Sponsor, the Sponsor, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. To the extent permitted by applicable law (taking into account any statutory guarantees applicable to consumers under local laws), Prizes are awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). ARV of the prize is based on available information provided to Sponsor, and the value of any prize awarded to the winner may be reported for tax purposes as required by law.

Winner (regardless of country of residence) will be solely responsible for all applicable federal, state, provincial, territorial, and/or local taxes, and for any other fees or costs associated with the prizes received, regardless of whether they, in whole or in part, are used. Winner will be solely responsible for complying with any tax reporting obligations. Please consult a tax professional to discuss your tax obligations and individual situation. If the winner is a US resident, they will be required to provide Sponsor with a valid social security number before the prize will be awarded, for tax reporting purposes. If the winner is a US resident, an IRS Form 1099 will be issued in the name of such winner, for the actual value of the prize received. If the winner is an eligible Canadian resident, an IRS Form W-8 BEN will be issued in the name of the winner for the actual value of the prize received.

Subject to the unclaimed prize draw clause, if for any reason the winner does not take a prize (or an element of the prize) at/by the time stipulated by the Sponsor, then the prize (or that element of the prize) will be forfeited. Any unclaimed prize will be forfeited. Prize, if legitimately claimed in the timeframes set forth herein, will be awarded. The Promotion Parties are not responsible for and will not replace any lost, mutilated, or stolen prizes or any prize that is undeliverable or does not reach the winner because of an incorrect or changed address. If the winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited, and the Promotion Parties will have no further obligation with respect to that prize or portion of the prize. The Promotion Parties are not responsible for, and winner will not receive the difference, if any, between the actual value of the prizes at the time of award and the stated ARV in these Official Rules or in any Promotion-related correspondence or material. Sponsor will attempt to fulfill the properly claimed prize within approximately six (6) to eight (8) weeks after winner verification.

8. GENERAL: To the extent allowed by applicable law in the winner’s jurisdiction (ex., Canadian laws for a Canadian winner, and the laws of the United Kingdom for a UK winner, for which Sponsor will request a separate waiver and consent, consistent with applicable data privacy law, and which may be revoked at any time), winner hereby expressly grants to the Promotion Parties and their respective successors, assigns, sublicensees and designees, the irrevocable right to use and publish his/her name, social handles, likeness (photographic or simulated), image, voice, biography and place of residence for all purposes, including, without limitation, advertising, marketing, promotional and publicity purposes in connection with this Promotion (“Advertising”), in any and all media now or hereafter devised, worldwide, in perpetuity, without any form of notice, permission or any amount or kind of compensation, except for the awarding of the prize to the winner. All copyright, trademark or other intellectual property rights in such Advertising shall be owned by Sponsor and/or its licensors, and each winner hereby disclaims and waives any claim of right to such Advertising, to the extent permitted by applicable law. To the extent permitted by applicable law, such Advertising shall be solely under the control of Sponsor and/or its licensors, and winner hereby waives any claim of control over the Advertising content as well as any possible claims of misuse of winner’s name, image likeness or voice under contract, tort or any other theory of law, to the extent permitted by applicable law.

To the maximum extent permitted by law in the applicable jurisdiction, the Promotion Parties do not assume any responsibility for any disruption in the Promotion, including, but not limited to, the failure or interruption of any social media platform or any internet service provider. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Promotion materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control. In the event Sponsor is prevented from continuing with the Promotion by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Promotion by any party, or any federal, state, provincial, territorial, municipal, or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each, a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend or terminate the Promotion or prize, or disqualify any entrant. Sponsor additionally reserves the right, in its sole and absolute discretion to modify, suspend or terminate the Promotion should causes beyond Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Promotion, subject to any written directions from a regulatory authority. This right is limited to cases where there is good cause. This applies if the Sponsor cannot reasonably be expected to continue the Promotion due to circumstances beyond its control, taking into account the interests of the participants.

9. CONDUCT: The Promotion Parties are not responsible for the actions of entrants in connection with the Promotion, including entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity, or proper conduct of the Promotion. The Promotion Parties reserve the right, at their sole discretion and to the extent permitted by law, to disqualify (or terminate the prize of) any individual who is found to be, or suspected of, acting in any manner deemed by the Promotion Parties to be in violation of the Official Rules, or to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person, or to be tampering with the entry process or the operation of the Promotion or website, or engaging in any unlawful or other improper misconduct calculated to jeopardize fair and proper conduct of the Sweepstakes, and void all associated entries, to the extent permitted by applicable law. Any such decision shall be based on objective and verifiable grounds. CAUTION: ANY ATTEMPT BY A USER, YOU OR ANY OTHER INDIVIDUAL TO DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE PROMOTION PARTIES RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

10. LIMITATIONS OF LIABILITY AND WAIVERS: To the extent permitted by law (taking into account any statutory guarantees applicable to consumers under local laws), the Promotion Parties assume no responsibility or liability for: (a) lost, late, stolen, undelivered, inaccurate, incomplete, delayed, misdirected, damaged or garbled registrations, entries, URLs, or emails; (b) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (c) any unauthorized access to, or theft, destruction or alteration of entries or registrations at any point in the operation of this Promotion; (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, cable, satellites, servers, computers or providers utilized in any aspect of the operation of the Promotion; (e) inaccessibility or unavailability of the Internet, the Website, any Promotion-related website, or any combination thereof or for computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, social networking posts, the announcement of the prize, or in any other Promotion-related materials; or (f) any injury or damage to entrants or to any other person's computer which may be related to or resulting from any attempt to participate in the Promotion including taking or using the Prize. If, for any reason, the Promotion (or any part thereof) is not capable of running as planned for reasons which may include, without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, then the Promotion Parties reserve the right at their sole discretion to cancel, terminate, modify or suspend the Promotion in whole or in part. If terminated, the Promotion Parties will award the prize in a random drawing from among all non-suspect, eligible entries received for the Promotion up to the time of such action. Errors and omissions may be accepted at the Sponsor's discretion.

11. RELEASES: All entrants, as a condition of participation in this Promotion, and to the extent permitted by law (taking into account any statutory guarantees applicable to consumers under local laws), release, discharge, indemnify and hold harmless the Promotion Parties, and each of their respective directors, officers, employees, agents, successors and assigns (collectively, “Released Parties”) from and against any and all liability, claims, costs (including attorneys’ fees), losses, damages, fines, or actions of any kind whatsoever for injuries, death, damages, or losses to persons or property which may be sustained, in whole or in part, directly or indirectly, in connection with: (i) participation in any aspect of the Promotion (including travel to/from any Promotion activity), (ii) the receipt, ownership, use or misuse of the prize awarded, including any travel associated with any prize, (iii) the Released Parties’ violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; (iv) entrant’s registration material on any related website, or (v) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Promotion activity and/or prize.

12. GOVERNING LAW AND DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of Wyoming, USA, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Wyoming or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Wyoming. Any action seeking legal or equitable relief arising out of or relating to the Promotion, or these Official Rules shall be brought only in the courts of the State of Wyoming. You hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum nonconveniens or lack of personal jurisdiction you may otherwise have.

BY ENTERING THE PROMOTION, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

For Residents of Canada and the United Kingdom: The above choice of law and jurisdiction does not deprive entrants of the protection under mandatory statutory provisions that cannot be waived under the law which would have otherwise been applicable. Nothing in these Official Rules shall be construed to limit or exclude any liability of the Sponsor for fraud, death or personal injury caused by the Sponsor’s negligence. Further, nothing in these Official Rules shall affect an entrant’s statutory rights.

For Residents of Australia: Notwithstanding the above, nothing in these Official Rules limits or excludes any statutory guarantees applicable to consumers under Australian law. Participants may bring legal proceedings in the competent courts of their place of residence in Australia.

ENTRY INFORMATION AND PROMOTION COMMUNICATIONS: Personal data of entrants to the Promotion (including his or her name, address and other information) will be processed by the Sponsor and third parties acting on the Sponsor’s behalf for the purpose of administering this Promotion and complying with applicable laws, regulations and rules. Except as noted in these Official Rules, information collected for this Promotion is used only for the purpose of proper Promotion administration and winner notification and will not be re-used, sold or shared in any manner by the Promotion Parties or any third parties unless the entrant has expressly opted-in to receive additional information or promotional material from Sponsor or a third party, or on a Promotion winner’s list, if and as required by local laws. Entrants have rights under applicable data protection laws, including the right to access, rectify, or erase their personal information and to restrict or object to certain processing. In the event of any discrepancy between the Sponsor’s Privacy Policy and these Official Rules, these Official Rules shall control and govern.

14. MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. Likewise, if any provision of these Official Rules is deemed invalid or unenforceable in some jurisdictions, but not others, such provisions shall remain valid and enforceable in such jurisdictions where they are valid and enforceable. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials, privacy policy or terms of use on any website, social media platform or application and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
